Supply Teachers and Agency Workers Regulations
Under the Agency Workers Regulations, after an accumulated 12 weeks in the same role with the same school or LA, a supply teacher is entitled to the same pay and conditions of employment as teachers employed by the school or Local Authority.
If a supply teacher is working before and after the summer holidays and is, for example, 6 weeks into a qualifying period for equal treatment, the qualifying period would pause at the end of one term and start again at the beginning of the next, provided that the agency worker returns to the same job with the same hirer.
